How hard is divorce during a chapter 13 bankruptc? How would it be done? What would change? We have 3.5 years left in it.

I haven't gone through it myself, but my understanding is that you and your spouse will have the option of continuing to make the payments to complete your plan or bifurcate your case into two cases. Either way, your plan can probably be modified to reflect what are probably increased living expenses of living apart. Your divorce attorneys should contact your bankruptcy attorney to make sure the marital settlement sufficiently addresses the bankruptcy issues.LadyInTheRed is in the black!

I went thru divorce about 2 years into my 13.
We sat down with our Ch13 attorney and they went over our income again, but allowed reasonable expenses for both parties for things such as rent, food, etc.
We had our monthy payment drop a few hundred dollars as a result.Chapter 13 Filed Feb 2010, Confirmed May 2010
