    IRS Question

    I need some advice. Back in April when we filed our taxes we talked with a Bankruptcy Specialist at the IRS. We knew we owed about $700 for last year's taxes and we wanted to know if we needed to pay that. We were told by this guy 'no, you'll only get one notice and that's it... you pay what you can if you can'. Well, we haven't paid anything. We got a letter in the mail today from the IRS showing the outstanding balance, letting us know that we do not pay in FULL within 10 days they'll put a federal tax lien on us. Weren't we supposed not to do anything? Why did we get a letter? We called the guy and left a VM... we'll see if he returns our call tomorrow. I don't want to hear "yes, you're fine". I want some peace of mind knowing that a lien will not happen and that we'll stop getting these notices.

    I did speak to another girl today who was not handling our case (as opposed to this other guy who was not available) and she said that because last year's taxes (2005) were not included in the bankruptcy, we were responsible for them... to speak with this guy and make some arrangement... But We don't have extra income... are they going to make us pay some or all of this at once?

    Should I let our attorney know? He's already been paid in full according to the records, not sure how willing he'll be to help. Any advice? Thanks!

    You're in the Ch 13 folder but you didn't say if you are currently in Ch 13 - are you? Where are you in your plan? Even if your lawyer has been paid in full, if you are in Ch 13 he's your lawyer through your plan until your discharge is final. Call him right away - don't wait! You don't want to mess with the IRS.

      I know with mine and my now ex-wife's chapter 13. She ended up owing taxes for a previous year. They were going to put her into a payment plan with them (IRS), but what ended up happening was the IRS debt ended up going into the repayment plan as a priority payment, and all the funds that would have normally been divided out to the creditors all went to the IRS as repayment. But I was in contact with the IRS Bankruptcy division, and also in contact with our lawyers and trustee. She ended up owing mid way through our chapter 13.

        We are currently under Ch 13. We filed under the old law... still some 20 some months to go. When we talked to this IRS guy before he said not to worry, we didn't have to pay anythign while on Ch 13 because we obviously did not have any disposable income. But now we got this letter and I don't know what to do. I'll talk to my lawyer and see what he says about this... I don't want them to come after us and put a lien on us...

          NEWS - DH spoke with the guy who's handling our case at the IRS... He said the reason we got that letter was because they were supposed to put a "Bankruptcy Freeze Code" or something on our account and they never did. So, he's going to request it be put on our account asap and he'll send us a letter of confirmation (hopefully soon - remeber, they'll take action in 10 days from yesterday if we don't pay in full!). He'll also send payment vouches for us to make payments - any amount we can pay is ok, it won't be a fixed amount. So it looks like we can finally breathe now - although I'll be so much more happy when I see this letter in the mail....
