    over payment?

    i am 36 months in to a 60 month chapter 13. I have no unsecure debits. i have sent 3 years worth of income tax to the trustee. (total amount of income tax is about 8000.00) my balance according to the trustee 5200.00 i am paying $458 a month, if i am figuring correctly 458.00 X 13 months would pay this off. will i still have to pay all the way to 60 months? should i call my trustees office and ask them will it be paid off earlier. any in put is appreciated thanks

    ps i guess the balance went down from the big tax refunds i sent them i hope this will knock some months off?????????

    Several court cases have been decided recently around when a Ch 13 can be paid off and whether the creditor payoff has to be 100% or not regardless of how many months into the plan the debtor is. Don't make the assumption that all you have to do is pay off what's left of your plan. Ask your lawyer to ask your trustee about an early payoff and see what he/she says. Keep us posted, ok?
