My metting is scheduled for August 30. I am really nervouse about this any suggestions/ideas about this? I filed a Chapter 7 in 2000 and wonder if they will ask about that. Any thing anyone can tell me would be great.

If you are talking about your 341 meeting, it completely depends on the Trustee and the circumstances of your recent filing. If your Chapter 13 filing is because of credit card debt that you incurred, the Trustee may ask more probing questions, wondering why you didn't learn your lesson after the Chapter 13. Again, it depends on the Trustee. Some may look at it as a factor, some my ignore it all together.

Try to stay calm. Easy to say, hard to do, ha, ha. I was so nervous when I had my second 341 meeting. Yes, I had two 341 meetings. I originally filed a chapter 7; had to convert to a chapter 13. My first 341 meeting was horrible. Talk about getting chewed up and spit out. The trustee was a rude jerk. My wonderful attorney just sat there and did nothing, Clarence Darrow, he is not. The second 341 meeting, I did all of the talking because of my attorney being an idiot, however this trustee was a real sweetie. In fact, I have not had any problems with the trustee's office since I am been confirmed. Let us know how you do, we will be rooting for you. Good Luck

They will ask about previous BKs; we had to file BK 10 years ago when my husband's ex took us to the cleaners for more child support...it was exorbitant and we got stuck with all her high price attorney fees, etc...it was a horrible time and I had just had a baby and was working full time. Both of us worked 2 jobs but it wasnt enough. It was painful to admit but believe me you dont want to lie to them. It is what it is. The 341 is not nearly as bad as you fear but it does depend on who the trustee is. Ours was really nice; some of the ones in our area are brutal so it is the luck of the draw. We had a decent attorney but fortunately he didnt have to say much. FYI I was scared too about disallowed expenses...one in particular. We did have to explain it in more detail but once we did the trustee was okay with it. There is no way to know for sure how it will go but the vast majority of us breezed through our 341s. Good luck!

I was just wondering about your 1st 341 meeting when you tried for chapter 7. Could you explain why they dismissed 7 for you. What exactly made the trustee decide to convert you? We are also trying for chapter 7 but are well above the income to do this. However, our expenses are over our income monthly even after all the unsecured debts are gone and our attorney is giving it a try. I am so afraid we will have to convert to chapter 13 as well. We filed under the old BK laws. The U.S. Trustee disallowed some of our expenses which provided us with more disposable income. Our attorney said that we were on the fence; it could go either way. We chose to file the Chapter 7 first, knowing that they may make us convert to a chapter 13. I wish that I could be more help but I really am not familiar with the new law. Good luck. I didn't get converted we filled in 2000 and it was completed. We since have had 2.5 children and just to many expenses. We feel behind and couldn't seem to catch back up. So we had to file again but Chapter 13 this time.

I wouldn't worry too much. I also filed for Chapter 7 in 1999 and didn't have any problems. All he did was say something like "according to these documents, you filed for Ch. 7 in 1999; is this correct?"
