Our Ch 13 payments are made through our employers. They are taken out of our paychecks every 2 weeks. WE get paid on Friday's. My payment usually takes about 1.5 weeks to get to the Trustee, and my husbands are always there 2 days after his employer sends it in. However, we got paid Friday before last and his payment hasn't posted yet, while mine has. His paystub shows the Ch 13 amount was taken out of his pay - What happened to the $ and why is the Trustee not showing it? Should I worry and/or do something about it? Please - Atty's are useless now that they've been paid. Will the Trustee contact his employer or our atty?

I would contact the trustee's office to find out if the payment has been received. Explain how it is taken out of DH's pay and sent from the employer. They want to see proof of the money coming out of paycheck. They may also want you to follow up with the employer to see if the check is still outstanding. No, My trustee doesn't use the NDC that I know of. They use another website called ramapo.Comment

You definitely don't want this to get 30 past due. I would call the Trustee's office. Make sure they got it. If not, offer to send them a copy of your husband's pay stub that shows the deduction.Date Filed: 12/19/2004

Ok - Turns out I do have access to the NDC - just registered. It doesn't seem as if his payment has been received. I told DH to contact his payroll office and find out before I contact the Trustee. I am really worried.Comment

It has only been just over a week since he got paid. I wouldn't panic yet.
His payroll office won't know anything. All they will say is "yes, the money was deducted and sent."

Well, I know it's only been a little over a week - but his payments get to the Trustee usually on the Tuesday or Wednesday following the prior Friday when we get paid, so this unusual. Mine usually take about a week and a half and they received mine for the last pay period already, so I'm kind of worried. I will wait to see what happens this week, if nothing happens, I'll contact my Trustee. I just don't want to have any problems - let alone now that hubby will be going away on a military deployment.Comment

Put your mind to ease and call the trustee. If they say they haven't received the payment yet, wait a week and call them again. I wouldn't panic. You are 100% right, JMan - zoomzoom and her husband do have the right to special considerations since he is active military and will be deployed to a war zone. Yeah, he'll be going to the Middle East for at least 4 months. My lawyer said to keep sending the payments - we'll have make a M.O. since he won't be getting paid from his employer. He'll get military pay, though and that would come down to about the same amount of income. I don't mind making the payments. Anyways, If I see his payment hasn't gotten to the Trustee next week then I'll contact him. It's just very strange that it's taken so long.Comment
