Hi all, I'm hoping someone out there can give me some help. I had a providian account that was discharged in my chapter 7 back in january. Somewhere in there I received a letter from Providian notifying me that my account had been moved (sold?)to washington mutual. My bankruptcy discharge clearly states that the providian account had been discharged but It seems every other month I receive yet ANOTHER bill collector letter stating that they bought the account from the previous guy and I need to pay up or be sued. Each time I've called the company and after being harassed a little (I guess they're trained to do that) they take down my bankruptcy info and tell me its taken care of. I honestly think that what they are actually doing, is that they find out they're not gonna get money from me so they make money by selling it to the next guy and never even write the bankruptcy stuff down at all. I am really getting sick of this. What should I do to end this once and for all????

Have you pulled your Credit Reports or monitored them since you filed BK??
Maybe that would be a place to start. Work on cleaning up inaccuracies there. Make sure everything is reporting correctly with the Credit Reporting Agencies.
There's a section of the Forum devoted to After the Discharge. For Credit Rebuilding, Getting a Mortgage, Buying a Car, and Lifestyle Changes to remain Debt Free.
There's a lot of tips and tricks in that section as well as some very good form letters you could use.
You aren't the only one that's had this type of thing happen. Many folks here trudge thru the BK journey only to get hit on the other side by old Creditors and Zombie Debt Collectors climbing out of the woodwork.Filed Ch 7 - 09/06

Did you file Ch 7 with a lawyer? If you did, your lawyer can help you with this because this creditor is violating the automatic stay trying to collect on a debt that was discharged in bankruptcy. If you filed without a lawyer, then it's up to you to inform this creditor they are trying to collect on a debt discharged in bankruptcy and if they persist, they will be hearing from your lawyer.This notice should be sent in writing with a return receipt so you know they received it and when.Originally posted by hope21 View PostHi all, I'm hoping someone out there can give me some help. 06/10/11 - Trustee confirms all payments made
08/10/11 - DISCHARGED !
10/02/11 - CASE CLOSED

Fwd it to the trustee or whatever agency enforces it.
If the CR says zero - that's good enuff 4 me. Eventually those letters will subside. I'd throw them out.
If they call - i'd tell them i'm recording the conversation and fwd'ing copies to the govt. Usually shuts them up.
