    Yippee! Discharged!

    I just checked Pacer and we are discharged as of 9/21/06! Our last day for objections was 9/19/06. I can't wait to get home and tell the hubby.

    It'll be a while till we're closed because our no asset went to an asset case when the trustee's appraiser valued our home higher than we did and we had to pay a settlement. Our POC deadline is 12/13. But the settlement was tiny compared to our debt. I have to say that our trustee and judge have been just great! Very helpful and easy to deal with. And bless our attorney who originally was going to do a 13 for us and then decided to go for a 7 and made it work.

    I'll admit that I was scared to death at our 341 and left the room crying when the trustee said he wasn't abandoning our home or truck and that he needed an appraisal on our home. The time between that and when we got the appraiser's report was probably the worst. It really sent me over the edge and that's when I had to get some medication to help me through. But the appraiser was very fair and the trustee was great about doing the settlement.

    Then we had to go to court for our reaffirmation agreement on another vehicle because it was listed as causing an undue hardship. I was afraid if we didn't get that approved that they would try to take the payment amount and push us into a 13. But we made it through that, too, and the judge approved our reaffirm.

    As a side note, also at our 341 was a rep from Chase who really grilled a woman that went before us. We had Chase cards too, and I was glad to see him go out the door when he was finished with her and didn't want to talk to us. I would've really been a basket case - he was mean.

    And so much thanks to the folks here. I'm mainly a lurker (didn't want to jinx myself by talking about our case), but I have spent hours and hours reading posts. And whenever I have posted a question, everyone was very helpful.

    I feel kind of like I just gave a speech at the Academy Awards or something - sorry 'bout that. Just excited!

    Congratulations! That is great news. I cant wait until I can post that I have been discharged.

        Getting our bankruptcy officially discharged is about as close to winning an Academy Award as most of us will ever come! You deserve your time on the podium, and congratulations!

            Oh, that Chase dude!

            It was surprising when the trustee asked if anyone had any questions for her and this guy stood up and said "Yes, sir. Mr. Blah Blah for Chase." He went up to the table and sat down right next to her.

            He started asking her about every charge she'd made on her Chase card in the last year. He went right down the line - on June 12, 2005, you made a purchase for $500 at such-n-such store, what was that for? In July of 2005 you charged a total of $2000, what was that for? It sounded like she had charged a bunch over the last year. Which had me worried, because although we hadn't used our Chase cards in quite a while (and none in the 70/90 day period), we had gotten a cash advance for the mortgage and some other bills on the cusp of that time period. I thought maybe one of the other suits in the room could be there for me. Thank God there wasn't.

            Anyway, she kept her composure pretty well for a while and then she started to get mad and snippy. Her lawyer never said a word, and neither did the trustee. They just let the Chase guy go on. Then he asked her about a $5000 charge she'd made in January 2006 (our 341 was in July) and I remember her specifically saying it was for dental work. He asked her if it was cosmetic or medically necessary. She, of course, said medically necessary and he asked her to explain the details.

            This went on for a good 15 to 20 minutes. I would have wet myself. It was several thousand dollars that he questioned her about and that was probably the reason why he was there.

            When he was done he just got up and left. The trustee asked if there was anyone else, and when no one said anything he told her she could go. I've always wondered whatever happened with her. She was a single gal filing an individual Ch7.

            I hesitated to mention this because I know everyone freaks about the 341 and I didn't want to add any fuel to anyone's anxiety. I think this girl must've really gone crazy with Chase or something. I'm sure this would never happen to anyone that's reading this!

              If it helps anyone feel better, we had a Chase MC with no charges on it for awhile before filing. Never heard a peep from Chase MC during our 341 or after (although they did put their claim in to get their share of $ from our trustee).

                Many congrats. I will never have a chase card again. Those people are from hell. BTW, I did have one creditor show up (not chase) and was grilled for 20-30 minutes. This suit started asking all kinds of questions and then the trustee would say "Oh, yes I did not think of that". I thought this idiot was going to ruin my case. I truly thought I was going to either puke or die. I did not do either , but I had major anxiety.

                  Congratulations on the Discharge!!

                  When the Trustee asked if any creditors had any questions for the debtor at our 341 today I held my breath. We were a little concerned about Sears coming after us for a tractor we purchased about 2 years ago. NO one showed up and we will just keep hoping it stays that way until discharge!

                    i dont understand the chase guy.

                    she could've charged for whatever. what diff does it make?

                    she's filing bk cuz she can't afford it now. All he could've odne is tried to prove she ran it up cuz she knew she would file bk. Which is hard to prove.

                    So his employer wasted thousands for him to travel and show up - for naught.

                    Maybe they were fishing and seeing how it's like and if it makes a diff.

                      I guess I wanted to ask since the 341 seems to be this mysterious "black box" that all go into and most make it out "alive". For myself, if I don't have an idea of how things could go bad, I will dream up visions 100x worse than they could actually be in the 341. At least hearing about these prepares you for the possible outcomes.
