341 meeting question

    341 meeting question

    I have a 341 meeting, my husband and I; and I was wondering what it is going to be like.
    I noticed that there are several other people filing the same time as us; same day some had different trustees though,
    Is everyone that is filing the same day as us, are they in the room listening to each of the cases or are we in the room with our own trustee, attorney by ourselves?
    What should I expect?
    What is the duration that I should expect to be there
    There are a total of 2 other people before us @ 9:00 am with the same trustee, but about 8 with another trustee.
    Who else is in the room?
    We have to go on the 17th of November, and we have to bring our 2yr old, he is a patient boy but I am just wondering what your experiences were, did any of you bring your child with you?
    Thanks I will be glad when the 17th is over I cant stand the waiting, thanks for all your help that got me through this I dont know how I would have got through with it if it wasnt for this site.

    Mine is the 16th and I have to bring my 21 month old with me. She is still breastfed so this should be interesting in court lol. I will post how it goes..case and baby

      Thanks I will wish you well, Good luck on the 16th, Im sure its alot easier than I am stressing I just cant stand the "not knowing"

        Most trustees specialize either in Ch 7 or Ch 13 cases. Also some states/districts have such a large volume of filers that they need more than one trustee for each type of bankruptcy. Either of these situations could account for the different trustees you saw.

        In our case and many other 341s I've seen reported here, typically everyone that is scheduled for that particular hour period sits together in the same room (not the official courtroom) with the trustee calling up cases one by one. The filer(s) and their lawyer (if they used one) go to the front when their case is called and are sworn in. Everyone in the room hears everything about all the other cases scheduled for that timeframe - all the questions the trustee asks and all the answers given by the filer(s) and their lawyer.

        What is the duration that I should expect to be there

        Depends on just where your particular case is on the list and whether both trustees are seeing people in the same room (unlikely). I would count on the whole hour just in case (and of course, the time to get to the meeting location, find the room, and the time to get back home )

        Who else is in the room?

        Typically all the other filers, the trustee, and someone from the court who is keeping notes, getting the paperwork in order, etc.

        Looks like ekelly already gave you a good response. I have to say that not one of the 30 or so cases we saw had their children with them. If you have any option of finding a sitter, it's likely to reduce the stress of the day, especially if your child gets fussy (as little ones are quite capable of doing after having to stay quiet in one place for a time).
