    Why does MBNA/Bank of Am keep sending notices of past due and letters from their collection department ? Anyone have this same problem

    I told them the first time they called my case no and Attorney info they have not called back.

    I left a message with my attorney letting him know they are sending statements and letters to me.


    Just wondering cause no other creditor has sent anything or called since we filed.

    Is this standard for them or are they just not aware of the filing , I checked my credit report and the account has been closed.

    (My apologies for having to ask such an obvious question - this account was listed on your creditor list when you filed, right?)

    Often in big cc companies like BOA (especially since they absorbed MBNA recently) it can take awhile for the notice that you've filed to wind its way through all the divisions that touch credit accounts. Has it been more than 4-6 weeks since you've filed? If it has, gather up what they've sent you and take it to your lawyer so he/she can send BOA a strongly worded letter about their violation of the automatic stay and that he/she will pursue legal action in court if the letters and calls don't stop immediately. They will definitely stop after that!

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections

    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
