    want to file on my own

    can anyone give me some of there expieriences or advice on doing this. I have done some research, i am a pretty strait forward chap. 7 with no assets, my main concern is the questioning if a creditor decides to dispute. and what risk am I taking by not having a lawyer.I do have a lawyer that can look things over for me, but not be present at hearing. thanks for your input. josh

    i get no takers, no problem can maybe some one just give me a link to a thread that may already be on this forum regaurding my question. thanks josh

      Many people have gotten the Nolo BK book.

      A good place to start also is:

      The info for the Means Test is there. If you're filing Ch 7, you'd use Means Test B22A. Approved Credit Counseling and Post Debtor Education Agencies are listed there. Down on the right hand side of the page in the "What's New" section is a link to the updated forms to be used for filing.

      At the top of the General BK Talk Section is a sticky of Links for Members. Lots of good info there.

      Also, you might want to get a PACER acct. There's a sticky in the Gen BK Talk Section for that as well.

        If you are determined to file by yourself, do a search using 'pro se' here in the forums - you will find all kinds of posts by members who have filed on their own. Don't bother reading posts that are earlier than Oct 2005 - the bk law changed then and any information posted here before Oct 2005 could be inaccurate.

        I highly recommend that you purchase two books on how to file Ch 7 pro se (without a lawyer) - the newest version of the Ch 7 Nolo book at http://www.nolo.com/product.cfm/Obje...0/213/161/128/ and Daniel Sitarz's book at http://www.amazon.com/Personal-Bankr...6523693&sr=8-7 . The $60 or so you spend will be very well worth it! Currently under the new law about 80% of the Ch 7 cases that are dismissed are pro se filers. These books can help you not be one of those.

        Also even though you don't intend to use a bk lawyer to file, make 3-4 appointments with bk lawyers in your area anyway. These intial consults are usually free and you can learn a great deal about your case that way. Best of luck with your filing!
