If you are talking about surrendering your car as a part of filing Ch 7 and then buying another car after your Ch 7 is discharged and closed, then the answer is yes.Originally posted by jec View Postif you give back one of your vehicles is this now considered disposable income or do you still get the exemption for that amount if you are planning on getting another vehicle
If you are giving up your current car and buying a new/used car before you file, then the answer is also yes . However, depending on the kind of car you buy, how much it costs, and when you buy it in relation to filing can be tricky. You need an experienced bankruptcy lawyer practicing in your area who is familiar with how the trustees in your local court feel about this to give you a reliable answer.
See my response to your other post - we need more information about your financial circumstances, your family size, your state, etc. to help you sort out your options and answer your questions better.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

my family size is 5
are daycare costs are going to cost 1275 a month that is 140 for an infant and 120 for a toddler and 75-100 after care for our older son
our income is the 90,000 but we have a large family and lots of expenses
my contribution to the income ins 2100 after they take out taxes
so i am pretty much working to pay daycare and expenses to work
i think we qualify but the irs tables are a little vague for instance is the cost of gas included in the measly amount they allow you for operating costs of a vehicle
