We were told by our lawyer to use the last six months paystubs....starting with the month you file. So if you file next month on the 20 th for example, you would use July and then count back. July will be prorated, that is at least how ours was done.

Unfortunately looking back at the previous years income and seeing that you were below themedian then doens't help your case much, they only are concerned with whether you are at the time of filing or not.

The reason I questioned the allowable figures you had posted, is because I looked at the Arizona ones and for the life of me even factoring in a family of 6 I still couldn't come up with that figure. Like I said on the means test you have to go by what they say, the allowed expense. Then on your schedules I and J is where you factor in your actual expenses. You are claiming alot of expenses so I presume the schedules is what it will come down to with your case. I am concerned about you filing so soon though, and on your own. Someone should have told you out of the gate, that you really do not qualify for a chapter 7 based solely on you husbands income alone.

    That rent is outragous.

http://www.legalconsumer.com this is the site I used. Used zip code 85041. put in the info for 6 people in household and 2 cars. My monthly medical is $300 this is what we pay on our own. child care is $150 telecommunications $150 ONe car note $480 plus insurance other car $280 plus insurance. On going medical expense $250, this includes my pump supplies, insulin, needles, testing, asthma meds for daughter and $150 to church (this may have to go, not working lol)
the system will compute the Arizona allowance for you.

Now you will see what I mean, this is the same means test that is used in chapter 7 forms. I even play down the expenses to give the worse case.

Please do the math, as stated before it seems hard to believe but it is true, however we will be moving to a much cheaper home.

Good deal, it is workable I will tell you that....but you just want to make sure you know all the ends and outs beforehand. Based on income you wouldn't qualify, that's why I stated it would come down to expenses and said as much in the other thread post # 34904283490 lol. If you number crunch, and your extra medical, daycare, and other expenses can use up your surplus after bills, then you should be alright.

However, do I have to show receipts for daycare... I pay my mom..

See my answer to this question at http://www.bankruptcyforum.com/showt...94686#poststop

Freshstart, if you will ask your questions in just one thread rather than duplicating the same question in both threads, that will make this give and take of replies go much more smoothly and you'll get better answers because we can keep track of what each of us is telling you better
