Question regarding taxes...

I am going to be filing for divorce soon, most likely January 2008. I am going to give the divorce a year (hypothetically) to finish. IF and when I file for BK7 (lets assume January 2009) and am asked to provide tax papers for 2 years what do I do?

I have not worked in 6 yrs. Once I leave the home I will be a full time student working p/t. I will be able to show taxes for 1 year (from p/t job), but to do 2 years goes into my marital/spouses income which he will be no part of my filing.

How is this handled? Basically, if I am divorced, can they force me to show what my (ex) husband made in 2007?

I would assume that they may want it, but if you two will be divorced they should see that his income is no longer yours as well. Of course, they'll see that on your paperwork anyway. I don't think it would matter, others will chime in. I'm no expert but I thought I'd try to help.

Since you have had no income, there's no expectation for you to file any income taxes for the last six years. You can't give the trustee what you don't have. All you have to do is explain the circumstances why you have no personal income tax filings.

If you and your divorced husband are still living together within six full calendar months of your filing and he is still supporting the household, then his income and income taxes could be dragged into your bankruptcy. To avoid that, it's best to plan not to file for at least six months after establishing two separate households after the divorce is final.
