    Checking account balance between filing and 341

    Hi all! Thank you so much for your help so far.. I have another question, please.

    My husband and I are moving out of state on Oct 26th. My 341 meeting is scheduled for Oct 23rd. I filed by myself, my husband did not file. We have a joint checking account.

    Because we do not have enough money in our checking account to finance our move, my husband had to get a pay advance. Which is around $1750. That money will be deposited into our account approximately 1 week before we leave, on or around Oct 19th.

    My question is do I have to report this to the trustee? My husband just took out a loan in the amount of $2500 last week to pay the arrears on our car to be able to keep it. We had to get permission from the trustee , they said since he did not file he is free to do as he pleases.

    I know the trustee is likely to ask me if I have had a raise in pay (I do not work, only my husband) but this is not technically a pay raise, it is a one time thing.

    I know I shouldn't volunteer any information.

    You should probably mention it it to the trustee, yes.

      FIM, since the money coming into your joint account is AFTER you filed and the money is your husband's, not yours, you do NOT have to report this to the trustee. If your trustee specifically asks a question about increases in income during your 341, this money is NOT yours so you can truthfully answer there has been no increase in YOUR income since filing. Ask your lawyer what he/she recommends you do in this situation.

      iplk, you are new posting here in the forums. I know you are just trying to help, but unless you are CERTAIN about what you are posting when you reply to a question, please don't reply. In this case, your advice is *NOT* correct! It's hard enough to file bankruptcy....having to sort out wrong advice from what is right just makes it that much harder.
