    Bye - Bye Judgement Lien !!!!

    hello all.....the bk judge signed the order this morning granting
    the motion to avoid and release the judgement lien against me
    by capital one bank!!!!! BYE BYE JUDGEMENT!!!!!FOREVER.....
    if creditors on the ammendment do not object by 11-09-07
    this thing will be over!!!!!!!!!!!! good day to all....guzzie

      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go

            Guzzie, I thought yours was all done?

            Do you mean like, you had two different sections of BK?

            One, all the bills were discharged & this other judgment/ ammendment was like a seperate BK?

              thanks all.....strange that after trying to deal with cap one attys about repaying in 2006, they would not listen and were very rude.....the judgement was entered in the local court of common pleas october 18, 2006......funny how those sob's who wouldn't negotiate with me, got snakebit and will now get NOTHING!!!!!!!!! serves them right!!!!!!!!!! thats what their greed got them.........I thank the lord for the outcome.......guzzie

              p.s. hi bandit.....the judgement lien is a seperate matter within my bk case ..... the motion was granted today so that part of it is over.......I was discharged sep 26, 2007......before the case was closed, I had to ammend schedule F by adding several creditors....
              they get a 30 day chance to object which I doubt they will because I have no assets and because I was technically discharged....
              but by law, they have to have a chance to respond......to re open the case and add the creditors would be $250.00 to the bk court...
              that's why it was filed before the case closed......if they don't object by 11-09-2007 the ammendment will be ordered filed within the case and it will be closed......my case was kind of strange but so far so good.......thank you for your concern and continued good luck to us all....guzzie

                  That's the reason our Court allows a 30 day waiting period after the last posting before Closing a case. To allow Debtors to come back and add Creditors or whatever and not have to reopen their case. At least that's what the Clerk told me on the phone.

                  I'm sure it cuts both ways. The additional 30 days has some value to the Court we might not be aware of.
