    Legal name change

    I've been wanting to change my legal name for a while. But now I am wondering how I should fit that w/ my filing bankruptcy within a few months. How should I time it?

    I want to change my legal name for personal reasons. It has nothing to do with my finances or with my creditors.

    What are you wanting to change? Your complete name or just first or just last? I hope you don't mind my asking... I'm just curious.

    I would think it would look suspicious to change the whole thing soon before or after filing but just first may not be a big deal. It may take a long time and since all your debts are in your "current" name, I wonder how that would pan out w/ a bankruptcy. I don't know the answer to your question but I hope someone can chime in and help.

      Both first and last. It's purely for personal reasons.

      I'm not in a hurry to do it, and I think I will be filing within a few months, which isn't long. Discharge should be by middle of 2008. I won't have any debts then, so I don't see how a name change could be a problem then.

        My instinct is to say not to change your name until after your bankruptcy is discharged and closed. No sense muddying up the water unnecessarily.

          Why? If you are listing all of your debts in your BK, what difference does it make if your name has changed?

            I think you are underestimating how much hassle is involved in changing your name. In a way, it is almost like filing BK, because you have to notify EVERYONE you are doing it, especially the people you owe money too.

            Basically, you would be creating a administrative mess by changing it before you file. Not everyone may have their records updated, you will have hassles with the credit reporting agencies etc.

            Thus, the cleanest way to do this is to file first, get your discharge, let the discharge filter through the system a few months, then change your name. And frankly, whats the rush, if it was that important to you and you have been "considering it for a while", you would have done it already...what's another 6-8 months.
