    341 over - reaffirm with circuit city???

    Not much happened - trustee was nice- asked us the typical questions everyone posting here says. He asked us to supply him with an adress for a piece of property my DH name is on.
    While we were there though attny told us circuit city sent a reaff. for a visa we had through them - the balance is 6800.00 - about 3000.00 are charges for tv and computer. - there rest were general purchases NOT at circuit city-- They want us to reaffirm the whole thing. What happens if we don't - we don't plan to do so -our attny. says they will call us and ask if they can come get the stuff. Nothing is less than an year old - it can't be worth much - each individual item - CC wouldn't be able to resell. How liely is it that thye will really want to come get it. I'd sign a reaff. on the stuff that they have a secured intrest in but I don't know if that is a possibility. Most of this stuff was form 2 or 3 years ago and no individual item was worth more than 1000.00 originally so I did not think this would happen. Obviously we still have research to do. My biggest concern is PHONE CALLS starting again. What should I say?

    95% chance absolutely NOTHING will happen. You'll keep what you purchased and not owe Circuit City a dime.

    Seriously, think about it....what would they do with old stuff? They can't sell it again - it's used. They are just strong-arming you to get you scared enough to sign a reaffirmation agreement and pay them $$. They want your $$, not your old stuff. Don't fall for it!

    My biggest concern is PHONE CALLS starting again.
    Circuit City CANNOT EVER CONTACT YOU DIRECTLY, period. If they do so, it's a direct violation of the automatic stay. No worries about any phone calls.
