    when to sell stuff

    I have my 341 meeting in a few weeks. When will it be ok to sell and buy stuff? Can I sell things like in a yard sale after it says discharged or do I need to wait untill it says closed on my case status?

    It depends on what the "stuff" is.

    Technically your trustee owns all your "stuff" now while your case is active. However, if you are selling household goods that aren't worth much and you'll net less than $2-300, then you should be ok. If you're selling something like furniture with a higher value, then I'd wait until your case is discharged and closed.

    Are you having a garage sale or buying/selling online at eBay or another online auction site? If you are doing eBay, then I'd lie low until you are discharged and closed. You could give the trustee the idea you have an eBay business even if you don't - not where you want to go before your 341.

    If you are using a lawyer to file, ask his/her opinion before doing anything to be 100% safe.

      lrprn is right, ask an attorney.

      See no evil, hear no evil, blah blah. If you are having a sale and getting cash I am not sure how they will know. But I don't advocate to sell high ticket items especially if you are listed an asset case.

      See, I am a pessimistic optimist. If it were me having the sale - my luck would have it that the trustee's wife is a diehard garage sale guru and of course they would hit my block only to see me selling. Then Monday morning being listed a fraud case - - Ugggh.

      Just better to limit the credit vs debit until after discharge. As I always say - "stay low".

        Yes, once your case is DISCHARGED, you can do anything you want with you stuff. Upon discharged, all of the BK estates assets are abandoned back to the debtor unless specifically claimed by the trustee before discharge.
