Okay, we have already had our 341 (no asset), we are looking forward to our final date of objections (6/28) and BAM! I receive a bill from All Children's Hospital for $1600!! My son had a procedure done shortly before we filed...we received a bill of approximately $7000, which we included in our BK but this one is a straggler that is clearly way past our filing and 341...what should we do? Can we still include it in the BK? Does this extend our date for objections if they are entitled to 60 days to object? I'm just not sure what to do...I will be contacting my attorney's office but I get a much quicker response here and I am a little freaked out! Please help...we can't afford to pay them the $1600 unless they allow very small payments plus I think it's pretty crappy that they send the bill for the procedure in pieces...I mean, how many more "pieces" might I get?

I have a similar issue with a few creditors who I included in my bankruptcy filing and my attny said to send the bill back to the creditor along with a copy of the first page of the bankruptcy petition and they should stop sending bills at that point. If not they are violating bankruptcy law and could face legal action. If you have an attny tell him/her about what's happening. Otherwise send the bill with the first page as mentioned.

Are both of those bills ($1600 and $7000) from All Children's? If so, I was told it doesn't matter if you listed all of the bills/accounts with the same hospital. I have a similar situation with a hospital (cath lab bill, anesthesia bill, laboratory bill, bill for my daughter's ER visit with a separate account #, etc.). It is my understanding that they have been notified of your filing and may not attempt to collect on any amount you owe them.

It doesn't matter when the bill arrived. What matters is when the hospital care now being billed for was given.
If the medical treatments included on your latest bill from All Children's were done to your son BEFORE you filed, then since you already listed them as a creditor that also wipes this latest amount out too.

okay, Thanks to all, you've answered my question. The procedure was just one, done before filing. All Children's is included in my petition, so I should be okay. I think I will take your advise, deafbroke, and mail my "remittance" of a copy of my petition coverpage. Thanks again everyone...that's why I come here first!

That's funny they were also included in our BK too and yesterday I got a letter from a collection agency they turned it over to after our 341 !!!!! The CA called me today and I told them it was included in our BK and gave them the filing # and my attorneys phone # ! The guy on the phone said " I don't know what to tell you " I said "well I don't know what to tell YOU" This was included and call my attorney if you have further issues ! Bastards !that's just weird it was also All Childrens !
