    Will they find out about BK...

    Will my employer find out if i file for Bk.... Are they contacted in any way...

    Not unless your employer looks at PACER for employee names....

    Or if you live in an area where BKs are published in the local newspaper.

    Nobody knows about ours, except for the people we've told...which doesn't include our kids, families or employers.

      It shouldn't matter. Unless I'm behind the times they can't fire you for filing bankruptcy.

      I had my wages garnished and needed to go to court for the 341 meeting and told management I needed time off for it. They said that there have been many from work who have went through it and it's not an issue with them.

        I've been worried about that too. There is always a chance since it's public record, but employers cannot fire you or discriminate against you in any way according to U.S. Bankruptcy Code Sec. 525.

          I recently asked a similar question. I work for a major retail chain and have Visa through them. They have their own bank so they will be notified when I file and I know for a fact that I am on their records as an employee. I understand they can't legally fire me just because I filed bk. But I'm really scared that they will find some way to get rid of me.

            I work for a bank, I owe them no money but I will need to file and am really worried as well. I have a coporate credit card and I will not be using it so it will have a zero balance on it would they still be notified I filed?

              If there is no balance on the CC there's no reason to list it in the filing papers.

                They may or may not; many newspapers throughout the country publish BK's in the newspaper just as they do births, arrests, marriage licenses, etc. It's public information/record. In our newspaper which is statewide, they publish a listing of filings every Monday in the Business Section very prominently - you can't miss it cause it is right next to the stock and other business information sections and always near their financial advice columns. Also, your trustee may require auto withdrawal from your paycheck if you file a Chapter 13 for your Plan payments. In that case, you will have to contact your HR Dept. to get that set up. HR, though, due to privacy laws, cannot divulge that information to anyone but if management wants to review your information in your files for any reason, may find it out.

                BK does not carry the big stigma it did at one time. Employers are usually understanding and if your job performance does not suffer in any way from the financial issues involved, no one should know unless you decide to tell someone and it gets spread. The best thing to do is act like nothing is wrong and don't say a word.
