We filed in April and had our 341 already. We are due for discharge the last of July. My DH has a great job interview that will put us WAY WAY over the median income. He plans on being honest if they ask to run a credit check and tell them what happened. My question is ...if he is hired 1 month before discharge will there be a problem with the income? I think his first check would only be like 2 weeks before discharge. Should we just ask for a check and not do direct deposit? We are so excited and really hope this job works out.

Your Ch 7 estate is set on the day you file. Check with your lawyer to be certain of course, but if the new money doesn't start until right before your discharge, that should be ok.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Best wishes with the job interview... my *GUESS* is that the bankruptcy courts realize that you were in trouble long before the job interview and obtaining a job is a positive step in the right direction on your part.

I am wondering the same thing too....I need to get a part-time job (hubby works) but the lawyer seems to think that it would put us too close to having disposable income. So I am wondering if after the 341, I can start looking for work or if I should wait until after it closes....we file on June 20th now? Sorry to threadjack....just looking for the same answer.

If you have an attorney ask them. I had many opportunities to apply for advanvcements at my job but I'm waiting until my case is closed. I do not trust the bankruptcy trustee at all and do not want to be forced into chapter 13.
