    Lien filed by HOA 2.5 months after filing.

    My homeowner's association filed a lien on my property nearly two and half months after I filed Chapter 7.

    In the grand scheme of things, does it really matter? (I am eventually surrendering the house)


    Is there anyway to get it removed or rescinded etc?

    Is the lein for fees that were incurred before or after your bk?

      If you are surrendering the house should not affect you. Liens are against property not people. It means that when it does go to foreclosure they'll have to pay off the HOA amount.

      However I'd call your lawyer and make sure just to be 100% sure.

      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

          You are responsible for any fees starting the day after you filed. You are not responsible for the fees anytime before or on the day you filed. I would say the judgement will remain but you could get the amount adjusted. Only the fees from before you filed will go away with the house.

          You still have to pay HOA fees until the deed it out of your name.

            Can you change the name on the deed before it sells? Indicate a Trust for example?
            If I close my eyes and imagine this was all a dream, will I wake up from this nightmare?
