    Is my discharge over due?

    Hi everyone,

    Hope you can give me some peace of mind. I have been waiting
    for my discharge letter. Today I called the automated system
    at the Court and my case status was "WAITING DISCHARGE".
    I dont know what that means.

    I could not get a hold of my attorney today.

    Here's my time line:

    Jan 19 - File with Court
    Feb 29 - Meeting with creditors. Trustee needed copy of a doc. reset new
    date. I faxed over docs.
    Mar 10 - New meeting. Trustee called. No need to appear. Docs OK.
    Apri 09 - Car reaffirmation. OK.

    Jun 12 - Today - over 90 days from the last meeting. Called the courte.
    Waiting Discharge.


    Does anybody know if this is a normal timeline and status at this point?

    Everything has been smooth so far. The only thing I ignored (advised by attorney) was a reaffirmation offer from Circuit City.

    Since my car reafirmmation I have not heard back from anybody.

    Am I over-reacting over this?

    Was your case a Ch 7 with assets for your trustee to liquidate and distribute to your creditors?

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

        You're "only" 2 weeks past the 60 days. It's not an automatic thing - the Trustee has to do paperwork to make the Discharge happen, and then the Clerk of the court has to enter it into Pacer etc... So there can be delays just getting this paperwork done. You could even just have a "lazy" or overwhelmed Trustee or sick or whatever...

        So the bottom line is that you WILL be discharged, your 90 days are up without incident so you are for all practical purposes discharged. You just have to wait for the red tape to be done.

        Mine took about 90 days (30 days past the 60 days after the 341). I hope your's does not, but it's not uncommon if you live in a big city. You can always try to call and talk to one of the actual Clerks in the court, sweet talk her/him and ask if they could please check your file for you.

        But don't lose any sleep over it, it's on its way.

            By the way, in my post I said it took "120 days, 30 days past the 90 day wait", what I obviously meant was that it took 90 days, 30 days past the 60 day wait. I edited my post to reflect the mistake.
            Anyway, the bottom line is, you will definitely hear from them within the next 2 weeks, so you can relax.

                We have 100 day discharge in my area.

                7/16- DISCHARGED!!!!
