    Should I feel good?

    Just received an OFFICIAL letter from the BK court. (Form L55)

    It says on the front of the letter: "The debtor is granted a discharge under section 727 of title 11, the United States Code, (the Bankruptcy Code)."

    but on the back of the letter it states "This court order grants a discharge to the person (or persons) named as the debtor (or debtors). It is not a dismissal of the case and it does not determine how much money, if any, the trustee will pay to creditors"


    This DOES NOT MAKE sense?????

    Anyone know what this all means????

    Should I feel good? Am I discharged???

    You can feel good - you are discharged.

    The "It is not a dismissal of the case" part is just "lawyer-speak" saying your case is not going to be dismissed (that's good!)

    The part "it does not determine how much money, if any, the trustee will pay to creditors" means *IF* your trustee was going to pay any money to your creditors, your discharge will not set how much money might be distributed. Since it sounds like you were a no asset Ch 7 case with no monies to distribute anyway, you don't have to worry about this part either.

    CONGRATULATIONS on your discharge!!

    Countdown: 60 months paid, 0 months to go

      As far as I know you want the discharge not a dismissal my wife filed bankruptcy 5 years ago and the case was dismissed. Well the creditors kept on coming. Very long story how her bankruptcy got dismissed.

        Thanks! I feel good now!

        But isn't a "dismissal" the same as a "discharge"?

        I was concerned about the back page - (which does seem like lawyer speak, and also seems as if it might be on everyones L55 - seems like some generic statements that are on all these forms)


        So is: "section 727 of title 11" a BK7?

        We did file for BK7 for sure!

          Dismissal isn't the same as discharge.

          Dismissal does not free the debtor from any debt.

            As Cali says Discharge and Dismissal in legal terms are not the same.

            Discharge is good
            Dismissal is bad

            So feel good which you seem to from the other thread
            May 31st, 2007: Petition Filed by my lawyer
            July 2nd, 2007: 341 Meeting Held
            September 4th, 2007: Discharged and Closed.
