    Credit Report

    After 6 months prefiling of bk7 I just pulled my credit reports and on my vehicle it states that it was a involuntary repo but I tried for months to turn the vehicle in and I know my credit report will change dramatically after I file etc and probably shouldn't worry about this but it still is not an accurate account of what took place. First is this something I can fix buy contacting the bank or is this just some type of default language the they use?
    Thanks for any advise you can give.

    If I understand your situation, you voluntarily surrendered your car back to the lender six months before you will file Ch 7. However, your credit report is showing the surrender as a forced repossession by the lender. Is that right?

    Since you surrendered the car before filing, then the lender can list it as an involuntary repossession to the credit report agencies. However, as you said, after you file bk it's a moot point anyway.

      Thanks for you info - The month that I stopped making payments (per my attrny) I contacted the bank and informed them that I was filing for BK7 and would like to return the vehicle - I had it for 4 years and up to this point had never been late on a payment. I kept getting the run around about there procedures and so I kept getting calls from the bank wanting me to make payments or they would have to repo the vehicle but I kept explaining to them that due to an BK7 situation that I would have to surrender the vehicle. Well about 2 months ago "wa la" it was gone. So now thats what shows up on my report.
      Thats the story. I'm just so anal about being clear and honest about this stuff I expect the same from the banks. So I guess it doesn't matter but still it is frustrating dealing.

        We didn't give our bank a choice...we just showed up one day, parked the car out front, and left the keys with the receptionist....no quibbling with them about voluntarily/involuntarily surrendering it, we just did it. If I'm reading this right, sounds like you tried to voluntarily surrender but they hem hawed around and then up and repossessed it one day...is that right? If so, your report is technically correct though not an accurate picture of what you attempted or hoped to do. Sorry to hear this...unfortunately, the bankruptcy path has more than its share of bumps for all of us.

          Thanks yep I'm just letting it go. I haven't even filed yet. So I guess as they say first things first!
