Wassup with AP when no C7 claim?

good lord have you no rights? this is harrassive, it seems to me. surely you could write this up and ask for pro bono representation? there has to be a legal eagle out there somewhere that wants to make a name and if ever there was a case for it, you guys are it.

strings need pulling, a lawsuit needs filing regarding the harrassment you've suffered. if it were me i'd get a lawyer to work up a lawsuit against this jack@ss suing him for a dollar amount/hour of the time he has caused you suffering, the loss of wages, all of the legal fees, any medical bills he might have incurred (anxiety, stress, etc), and of course, defamation of character. even if you have to give everything you might win in that lawsuit to your pro bono lawyer and c7 creditors, it'd be worth it for him to realize that you don't have to be a big fish to play big, you just have to be fed the hell up and backed into a corner.

the only positive thing i can say regarding this guy is that he won't be able to bother you in heaven. he is going to have some karma to work out for a long long while. ward yourselves with positivity and light, and fight the darkness. man i would be in the corner with my back up like a hissing cat right now.

You are right; we have no rights at all here. We attemped our own suit against him in 2005. The two attorneys working on it were green and eager to establish themselves and worked pro bono if we would pay the filing fees etc. Since this person posts anonymously you have to subpeona records and all that. We had that when the forum they owned was still located in the U.S., BUT then it became necessary to hire 'expert witnesses' who could identify this guy. After two attempts with two different experts ruling that they couldn't be sure, we gave up. Also now at this point, all our money was gone.

Since then this site has been moved to China, and here we are.

Have you filed a motion to dismiss?

Three of them all turned down as in the Bankruptcy Court it is looser than a civil Court.

We now have filed for Summary Judgement. I don't care which way it goes. He is intending to make an action big enough to criminalize it and has stated this on his forum.

I would just as soon give him the Judgment as we are collection proof. He has no real desire to win a Court case, he wishes to bleed us for lawyer fees. We are not smart enough to go pro se but are doing so. We attempted to voice this at the AP hearing and I told the Judge then, "give it to him" and the Judge said it isn't that simple but just don't show up at the trial. I'm a bit nervious about not showing but to go there without a lawyer the adversay lawyer would put us through a wringer. It is not what truth is, it is how you warp meanings to the truth.

The book would end up being a horror story. You have a point but right now, he is 'dogging my heels' and all we want is him to drop the idea that we are alive. That is what he wants to do, have us die. He has actually posted this and although I only read the place now and again, I get an idea of what prank he is about to pull next as he cannot keep his mouth shut. He thinks this is great fun and has told people who have relayed this back to us. Many in this town call him evil personafied. 'Hub

We have gone to every agency possible for relief. The FDLE (Florida Department of Law Enforcement) and unless it is a child, they just don’t want to be bothered with cyber stalking. It has become an obsession with this man, and his two business partners. There is no law enforcement in cyber land. As I said, if you wish to see our pictures ad nauseas, with every name in the book within, I will privately give out the URL in a PM. He has lost us three jobs. He has bribed the Mayor of this town. We have been accused of attempted murder, cutting brake lines, and about any thing you can think of and the police and sheriff just ignore it all as the feud is so well known to them they consider this man just a nut basket, not withstanding the mental anguish we have gone through.

I should have walked away from it years ago, but as I said, you don’t realize how fast a snowball gathers importance as it rolls down the hill of time. I do not negate my stupidity of pride and with a cyber stalker, they do not want to be ignored. That was the mistake, but hind sight has now cost us our wealth and health.

We now just ignore him and after his 180 million dollar AP for an alleged stolen email I just may allow him to have it. Any judge is going to ask how is he going to pay a judgment of 180 million when the same Judge just signed my C7?

I am not sure of the timelines, but I have to assume he is filing an adversary under 11 USC 523, which classifies non-dischargeable debts based on fraud. This guy must really be upset about something you may or may not have done. Is he using a lawyer?

523(a)(6) to be exact, yet he never brought it to trial. So how can you do something not proven, and on speculation attempt to say what you didn’t do was malicious, so we are granting this guy who never got a judgment, lien, or any debt, get his case or claimed himself as a Creditor, be able to take this civil suit to bk Court?

Sooooooo, that begs the question. What happened that caused this guy to come after you? Previous posts indicate he sat on his first suit for about 5 years(?) until you BK'd.

We have given small amounts of back story in bits and pieces. We have been the fly that is getting it's wings pulled off for fun. The man is narcissist and believes "everyone needs three people, one to talk to, one to love, and one to hate. The most important one is 'hate' as it is the amalgamator". He lives this credo.
