Making payments to BK atty. Do creditors have to stop calling while in this process?

    Many people send out letters prior to filing advising the creditor they will be filing shortly in the hopes the calls will die down (this is not considered fraud) - they hardly ever do until you actually provide the attorney's name, phone number and the actual filing (case) number. You usually have the attorney's name and contact information first in advance of actually filing but just providing that information to a creditor is no guarantee the calls will slow down. It's once you actually file is when the calls start to slow down and eventually stop.

    If creditor's call, just tell them you are in the process of filing, have retained an attorney and give them his contact information as you have done in your letter. They will ask you for a case number; just tell them to contact the attorney and leave it at that.

      In the past 6 months I've had maybe one collection agency call me and that was from a repo in 1996. I would say that most all of our creditors do not have our current phone #'s. I just want to prevent the nasty calls from happening before they do call. Until this month, we've been current with everything. I stopped paying the mortgage, home owner's insurance, BMW payment and a few CC's.

      We live way out in the sticks and have changed cellular companies several times. I had T-Mobile for a while and many creditors had that phone # and they now want $500+ from me for canceling which I did not have.

        This is what I did and it worked, only one creditor called and that was to inform me that they believed my debt was secured I told that to contact my attorney and they did she sent me a letter.
        I printed out slips of paper and put them in the payment envelope with the payment stub.
        All it said was please contact my attorney about this matter.
        I put her name phone number email address and physical address and fax number.
        I got one back saying please send this information to another address.
        I sent them one and I did not hear from them again.

          In my case, when the bill came, I looked for the "Billing Inquiries" address and sent my notices there.

          I bought a Bowflex around March of this year and financed it. Then in June I was in the hospital for 3 days and got a $40,000 dollar bill. I sent them a letter letting them know I am going bankrupt. My attorney said they have the right to come and pick it up. They will need a truck. The unit is all assembled and not easy to move around like when they first sent it to me. Sometimes the people will just write it off since their cost on it is so little and now that the equipment is used and not worth anything.

            If anyone became particularly agressive, you could send them a cease and desist letter (and your lawyer may very well do that!)

            That should quiet them down.

            One creditor asked my wife, "Have you paid your lawyer in full?" My response would have been, "None of your business! I said that I retained him." But they are just trying to figure out how long they have to collect from you.
