    Have to file a tax return, will this delay my filing?

    I have to file a 2007 tax return. I didn't because I didn't earn anything last year. Would I be able to mail in my tax form and give a copy to the attorney, or will they have to wait, I don't know for what, becasue I am not expecting a refund.

    Go to IRS.gov and review their information on who has to file a tax return - it will advise you as to your situation. Also mention the matter to your attorney.

        I told my attorney that I didn't file because I didn't work, he said you will need one to show the trustee.

        I feel stupid for asking, but I would get money back? Can you explain.

          I didn't file a 2006 or 2007 return due to not working and it wasn't a problem. I just had to sign an affidavit the trustee sent stating that I didn't file since I wasn't required to due to not working those years.

          If you didn't work at all, you are not requred to file and no reason to. If you worked just a little and earned under a few grand, you are still not requred to file but can get the taxes you paid back if you do. You might even qualify for a few dollars from the Earned Income Credit.

          If there is no income, there is no refund to get. Not sure what GreenInk is talking about.

            I never used the word "refund" purposefully. I meant child care credit, that sort of thing.

              Any of the credits require you to have income to qualify. So no income = no credit or refund.

              Only credit I can think of that you can get without income is that phone credit that was available for 2006. And if someone claimed her as a dependant, she can't even get that.

                The attorney said to file it anyway, just so I'll have it. Would I be able to give a copy of it to the trustee so I can go ahead and file, or do I have to wait? Not sure though what I would have to wait for.

                  I would just fill out the 1040EZ, sign it and make a few copies for the attorney & trustee before sending it off to the IRS. If a return is mailed in, you don't get a confirmation or anything, so nothing to wait for.

                  You could try filing it online somewhere but I'm not sure they will let you with no income to report.
