I don't even have a phone or a phone number. The last cell phone I had was back in 2004. For awhile they would call my parent's house phone but we got rid of that more than a year ago. Most of the time we left it off the hook because creditors called so often, for both me and my parents.

You don't have to apologize, Hub. In fact I'm learning a lot here and I appreciate everyone's willingness to share and give advice... if I hadn't signed up for this forum I would be freaking out quite thoroughly, ha. As it stands I'm not so much worried at this point as I am unsure of what direction to turn (do I file for bankruptcy or not? Can I do this pro se? and so on...) and how to go about doing it. I feel a little pressed with only one week to prepare, but them's the brakes.

Thank you Curlysue. In my opinion, I would go before the Judge, and don’t worry, it is not a big thing, just be yourself. If this is 2004 old, you may just say to the Judge, “Your Honor, this debt is almost five years old. I do not deny a debt, but I would request the Court to give me a detailed report that they can verify as accurate as to what I owe, when I owed it, and what charges and interest they are levying against me. As you see Your Honor, I am not employed at this time and am in no financial position to address this situation without more information”. That just may give you some time to think. Then, as required by the bankruptcy Court anyway, you must have two courses. One is pre-file as to your ability to become bankrupt and costs around $35 to $50 bucks. They ask you questions and assess your bankruptcy state. If you do not file, it will tell you why and if you do file you will have it out of the way. You must do this anyway if you file. You get a certificate that you must file to Court. Pro se is hard but not if you learn how. We did not do that but now I could. Get the Nolo.com book on C7 for about $18 downloaded in pdf. It has all the forms and all the instructions on how to do this stuff. Please keep me informed and you may PM me if you wish it off line. ‘HubIf I knew it all, would I be here?? I am ready to do suicide at any moment. I don't bluff. I always mean every word I say. If they honestly did send a collection guy here with a gun, I actually would beg him to kill me right on the spot to end all of this. I have suffered depression most of my life and all of this debt and problems just feed on it.
If they ever took me to court, I would still never pay and I would tell the judge and the entire court room that they would never get a dime and there's no a single thing they could do about it. If they ordered me to go to jail for any reason, I would proudly yell out, "YEE HAW! FREE ROOM AND BOARD!" I would insist that the judge keep me in there for life so I could just sleep all day and hang out until I die.
I no longer have a desire to go back to work for anyone. I am so tired of office politics, long commute times and low pay. I'd rather be dead than go work for anyone anymore. Honestly. My knees are shot from being overweight. That eliminates like 90% of the jobs around here as most every place requires you to stand on your feet for long periods of time. For me to take any job would require me to suffer in massive pain all day. There's no way I could ever do that. That's why I'd much rather be dead if I had the choice.

I guess, fortunately, CA's never show up at your house in person. Legal stuff doesn't scare me since I don't have any real equity in anything. There's nothing they can take from me.
I've hated my life ever since 2001. Any time I get anything, it always gets taken away. I've been burned so many times in my life and I feel like I have nothing to live for.

I've already put library holds on the 2007 and 2008 versions of the NOLO books because I can't afford them at this time, but I look forward to reading them. I suppose it looks like bankruptcy is the way to go, so I need to prepare, especially since it looks like I'll have to do it pro se. Hopefully I can delay the judgment until I get some cash to pay for all the filing fees, although I guess if the goal is filing bankruptcy a judgment won't matter so much? I'll probably be living with my parents until I get a BA in nursing (which would be accomplished, at the earliest, five years from now) so I won't have to worry about costs associated with living alone.
Right now I need to find information about delivering an answer to the court to buy some time, I guess.
If I go the bankruptcy route, I'm concerned about my private student loan that I co-signed with mom... mostly if it could be accounted in the bankruptcy and how it might affect my mother's credit rating. If I don't get to include that loan, then I'd be filing for bankruptcy over 7k's worth of debt... is there a limit to how little you can file over? And if I do file for either 7k or 11k (which I guess is low n comparison to what a lot of people file chapter 7 for) can and/or will they dismiss the bankruptcy over so little?
Ah, so much to learn...

Hey DM, whats up? I apologize for coming in this thread a little late since I just saw it. Look, your life is worth a lot more than any debt collector or debt amount. I cant get into a lot of specifics, but I was going crazy 3 years ago when I first found this site and at that time, I shared similar thoughts to you. But once you come here and learn about BK, and the way the debt collection laws and system works, its easy to realize its not worth getting yourself so worked up about it.

Hint: As you read and learn more about the debt law process, (and please allow yourself A LOT of time), use the search function of the forums with certain key words like "answers", "counterclaims", "motion to compel", "SOL"(statute of limitations), "affirmative defense", "Arbitration", "chain of title or custody", and the big one "DISMISSED"
Many lawsuits have been dismissed (won) due to debtors either hiring lawyers who obviously (or should) know how to win, or by going pro se armed with knowledge, courage, and tact, and DO NOT allow the time to pass for a default judgement to be entered against them!
