    Just got my PACER log in info

    I didn't realize until after I'd done that last week that I could have had instant access if I gave them my debit card number. Oh well, live and learn, right?

    I went to look and apparently there is only one creditor that seems to be objecting: HSBC. I bought a laptop from HP early in 2008 after my 8 year old one had died, and had it financed. I honestly had intended to pay it, but then the economy tanked, rising grocery and gas prices killed any extra money I had to do it. I do some work at home, so it's easier to use something I can port around if I need to, so I do sort of need my laptop. Anyway, they are apparently being represented by Bass & Associates. I've read that they are a bit unscrupulous. What can I expect from them? If I have to give it back, that's fine. I can save up for another one, but would they at least let me reaffirm? Or is that a no go?

    I have been reading about Pacer. What is this and is it costly? Will it help before you go for your hearing or is it for after the hearing?

      Is your laptop not considered a "tool of the trade"? If you use it for work, I would think it's exempt but I'm no expert either.

        If its a secured account and it sounds like it is you will get a few options after your 341. One of them is to reaffirm, another is to surrender the property. I can't remember the third, but to answer you question yes you can reaffirm the debt if its secured. And of course if the courts approve it by deeming thats its not going to be a hardship on you.

        Is it old? Computers don't hold their value, if its not almost paid off you might be better off to let it go back and save up for a new one!

          ANIME - I had HSBC send my account to the same Bass & Assoc. they sent me numerous letters and then when i filed they sent another one and then my attorney send them a letter telling them if they contact me in anyway we will sue. I have never heard from them again. HSBC is a Bit** to deal with and i think they send all there accounts to these people. They never showed at my 341 either.

            PACER is an acronym. It is the Federal Court Computer System and is great to look at your own case. I cannot conduct a class here, but I think there are some threads and 'stickys' about PACER. They scan your documents and both sides can see. It is expensive if you are not careful. Eight cents a page to look and usually pdf files. Save to your hard drive to save money on relooks. Best I can tell you now. 'Hub

              Tell them to come and get it, chances are they will never show up. They claimed that a client of ours needed to reaffirm the portion of the balance that was purchased within 90 days of filing. We told them that the client is willing to surrender the property, we haven't heard from them since and that was 6 months ago.

              They don't want a used computer, they want money. Wait to see what happens, but agree to surrender the laptop, let them come get it.

                Actually, the financing was 6 months no interest, which expired at the end of October, so I haven't gotten any nastygrams from Bass & Assoc.

                I do use it for work, and the lawyer listed it under my exemptions at about 250 less than it's actual value.
