    Hey Null - So sorry that this happened to you. It is big deal when you anticipate thatday of the 341 and then to have to go there and then be turned away for someone elses mistake. I would be sooo pissed. I hope everything is all fixed now, but i know that is no help, cause you still have to go thru the 341. It sucks. But i truly wish you luck and I would be on that lawyers ass like flys on shxx. I would check over everything that they do from now on. Goodluck again. Please keep us posted.

    i contacted the clerk again and she said everything was free and clear to go ahead with the hearing from what she could see. again, the trustee was not willing to tell me anything about why she continued the case, and said i would have to talk to my lawyer about it. i read the minutes of the hearing on pacer, and it gives no reason for the continuence. it mentioned nothing about missing paperwork, evidence of abuse, missing id, or anything like that.
    i contacted my lawyers office several times today and was told he would call me back and off course he hasn't. i'm just going to have to take more time off of work monday and go down there and find out what the hell is going on.

    Hey Null,

    So sorry to hear about your 341 continuation, I would be pissed too! Someone dropped the ball and screwed up big time. You have every right to rant, it's YOUR life that is being put on hold. Hang in there.

    it is a big deal to me, because someone else's mistake has set me back 2 more months when this should have been over and done with. it is a big deal to me, because if i get this job i want in texas before the end of next week, i have to figure out how to move out of state to there and still manage come back here for court. it's a big deal, because my sorry lawyer and his entire office is not communicating with me at all about what is going on. i paid for a service. i expect that.

    so yeah it's a big freaking deal to me and i am going to be pretty damn pissy about it until it gets fixed.

    You remind me of my wife...everything is a big deal, regardless. I guess I balance things out by taking the view that -nothing- is a big deal and I'll sort it out and life will go on.

    Just remember, even though your meeting has been rescheduled, that's not a bad thing. You're still under the protection of the stay and if no creditors have done anything yet, it's not likely they will now. We all know you want it over and done with, but step back and breath a little bit, accept the situation and calmly work towards a solution.

    there is nothing entered on the docket for 12/1. on the deadlines and schedules, it shows 12/01 that the compliance deadline was terminated and marked not 'satisfied'. all i can guess to figure is that the date was entered under the wrong column which makes it look like i failed to meet the deadline. it still makes no sense because in the documents it shows that they got the certificate on 11/18/08


    deadlines/schedules:
    6 Compliance Deadline 11/13/2008 (date entered) 11/27/2008 (due date) 12/01/2008 (date terminated)

    9 Filed & Entered: 11/18/2008 Certificate of Credit Counseling

    Hey, null... I was thinking. Did you check PACER to see if it was actually docketed on 12/1 or somewhere about that time? If it was... someone seriously dropped the ball.
