    Can wamu hit cr AFTER filed bk?

    Hi we filed on Dec. 10th. Just got an alert from the 12th that they filed a 90 day late on my cr. Are they allowed to do that after bk or should i try to dispute it someway?

    If you were late on payments PRIOR to filing BK, they are listing correctly on your credit reports.

      I'm confused by this. If you're bankrupting the debt, how will your credit improve if they continue to ding you with lates?

        If you are filing BK a "ding" in your CR is the least of your worries. after you file everything will/should be IIB included in BK. this isn't a good time to worry about your CR. You really want to focus on your post BK cash life. after discharge you can clean up the CR then give it time.

          For the CH 7 the reporting data is supposed to read IIB (Included in Bankruptcy) once you are discharged. Most of the creditor report it once you file. The history that you generated prior to the filing remains; however, once you file the account is closed and reflects, should reflect, IIB and a zero balance. You do need to check after your discharge each TL because some of the CRA's are notorius for not reflecting accurate reports.

            If you are late PRIOR to filing (or have chargeoffs, repo's, etc. prior to your filing date), that date is prior to your filing date and that information can be listed as such and it usually is along with the BK information because it took place PRIOR to the filing date. Most people prior to filing are late on payments and that information gets listed before the BK is filed - all that will change is that the BK will get listed and the late payment information prior to the filing will also stay. The only way your credit will improve is with time and your handling of credit from here on out and for several years after your discharge. We are two years past discharge (filed in April 2002) and we still have difficulties now and then with the Chapter 13 showing on our reports...thankfully it comes off in April 2009. All accounts under your BK showing late payments prior to the BK filing will start coming off 7 years after your Chapter 13 filing date. You can attempt to dispute the late payment information but they don't have to remove it due to them being prior to your filing date.

                thanks for the input. Not really trying to save credit as i know it is trashed with the bk just wondering if they can keep hitting me as the time goes on or if they have to stop at some point. I realize anything late before bk is on there and that's fine only have late stuff showing for 3 months prior to bk everything else was perfect, lol not any more!!
