Mortgage Company!

My husband just told me the mortgage company of our house that is vacant in Texas just called him. We changed our cell phone numbers over after they were calling constantly. They found where he worked where we just moved and called him at work. My husband told them we were filing bk and they said they would call everyday until they get a case#, Is this legal?

We retained the lawyer 2 weeks ago...filing soon if we can ever get the money

Give them the name and contact information for your retained attorney and tell them to call the attorney who now represents you.

1. Did he give them the atty's info and tell them to contact the atty?
2. Did he tell them that he can not receive personal phone calls at work? If so, they can no longer call him there.

They can still legally call you until you've actually filed, as the autmoatic stay is not in place until then. I'm not really sure why they'd really waste the time if they know you're going to file though. I'm guessing they were just trying to scare him.

I will tell him to let them know that. We are hoping to file sometime in February. Now I am worried that they are going to foreclose on us and we will have a foreclosure and bk on our reports/ ugh

Your CR is going to show IIB your husband needs to do like the other posters are saying can tell them to call the lawyer. after he tells them not to call at work.

what does IIB mean

I will let him know to tell them that and see what they say.

IIB = included in bankruptcy

Your credit report is suppose to show IIB and zero balance for all the tradelines listed in your BK petition.

The CRA's make lots of mistakes in reporting, so you will want to check your reports after your discharge and correct any mistakes made by the CRA (credit reporting agency).

Once you write them to stop contacting you, or any other person, by law they must do. They can however contact you personally to sue you. This is a common topic here and I don't take the time to do the legwork but do a search. 'Hub
