    question about household definition

    I have searched this board but can't find an answer... if I live with my boyfriend and we have a joint car loan together, but I write him a check for rent and half of utilities every month, is he considered part of my household or a roommate? We used to be authorized users on each others' credit cards, but took each other off when I started getting into trouble...

    and if he is considered part of my household, will all of his expenses be taken into consideration (specifically, child support and alimony that he pays, among other things)?

    I’m going to stick my neck out and take an educated guess: How long have you been together? You live in the same household; you don’t “normally” have conjugal rights with a “room-mate”. You cook together. Who owns the house? He does but you pay him so it goes to household expenses? I would say this is fairly a “Palimony” situation and certain suits have set a precedent for this type of arrangement. I hope this helps a bit. If you are not pro se, your lawyer would advise you best. In your complicated situation, please consider a lawyer for sure. ‘Hub

      We have lived together for a year, but he was living in my condo with me before, which is going into foreclosure, so he rented a house in his name only and I write him a rent check (we only moved a month ago).

        I still will stay with what was said above. You see, in that you have been together in some sort of household, does not matter where, you have a “household” and that equates to things of a legal nature. I am not savvy in that kind of stuff and truly advise you to speak to a bk lawyer. We have several bk paralegals and some lawyers here. Perhaps one will chime in. PM Flamingo.           You have a household as you share expenses, share joint use of some accounts and reside together. Renters and roommates don't have joint auto loans together and don't share authorized use of credit cards. His income as it relates to your household will probably be taken into consideration if/when you file. I would suggest getting a consultation with a BK lawyer and go over all this with him/her so you know exactly where you stand.

            I would say yes, if his income is considered, his expenses would be as well. If he's paying alimony and child support it may actually work in your favor since domestic support obligations are priority debts, they get taken "right of the top" of his income. Good question. Have you had an lawyer consults?

              Since BK is a snapshot at the time one files, what if one of you moves out for a while?

              A "breakup" could explain both on the auto loan, maybe? - jb
