    Two Questions about chapter 7

    Do I have to file a form B10 for each creditor I have?

    Do I need to include copies of all my forms like cc bills with my chap7 filing?

    My case is very simple no assets just small time dept to cc and medical.

    I don't know what a B10 is, but you do not need to include cc bills with the file. You might need them later on to show the trustee.

      B10 is a proof of claim
      not sure if I need to fill this out for each creditor.

      What about bank statements do you send those in with your forms or just the forms,

      any one know of a good web site the has a guide or instructions for this chap 7 forms. the Gov site is kinda vague

          Oh, I see. No. You don't fill out the proof of claim. If the trustee determines that you are an asset case, then they will notify all of your creditors to file a proof of claim. If you are a no-asset case, then creditors won't file the claims.

            I recommend the NOLO ch7 book. This will help you learn how to fill out the forms. As for what forms to fill out, most states/districts have a website that has will tell you which forms to fill out and in what order.

            You only file the paperwork for the BK, and not any of your personal info, except for paystubs. You are required to send your latest tax return to the trustee at least 7 days before your 341. The trustee will aslo send you a letter describing what other documentation that they want you to bring to the 341. This can include more tax returns, bank statements, more paystubs, cc statements, etc.

              The problem is these very helpful websites are matched to what is needed to file in that district and/or state. What may be right in that district/state may be wrong in yours.

              Have you purchased the Ch 7 Nolo book "How to File for Chapter 7 Bankruptcy" by Stephen Elias on how to file pro se? It's considered one of the best pro se filing resources. There's a downloadable version that costs less than ordering the book.

                My lawyer gave me a checklist:

                Pay stubs for the past 6 months
                Bank statements for Dec, Jan, Feb because I'm filing in March
                2005, 2006, 2007, 2008 tax returns
                Most recently dated billing statements
                Copy of vehicle title
                Proof of Insurance on vehicle
                Pay off statements on vehicle loan
                Copy of deed and recorded mortgage
                Most recent tax bill on property
                Pay off statement or monthly statements showing total owing on mortgage
                TransUnion Credit Report
                Certificate of Completion of Credit Counseling Course
