    Question for those who have filed in the Southern District of Florida

    Does the Southern District of Florida count your income tax refund as income when computing CMI ?

    On the forum I have read that some districts count it as an asset and some as income, I was wondering what the experience has been for those who have gone through the process here.

    Also, how do they view work expense reimbursements?

    Do work expense reimbursements count as income as well? Logic would say not, but who is dealing with logic in bk law?

        As far as I know, an income tax refund is an asset.

          In a Chapter 7, it's generally an asset. The only time I've seen or heard of it used as "income" is in a Chapter 13 where the attorney and debtor want to factor it in so that refunds are not the property of the estate (because they were factored as income).
