    Best Day Of This Whole Process - Cash Advance

    I checked pacer today at work... and then I finally saw the light! LOL There was my discharge waiting for me to print. I just would like to say thank you to the memberS of forum throughout this whole process. A lot OF questions anwered.

    Did anyone owe on a cash advance after their discharge? Right now I have one cash advance out, I have been doing my research and it looks like I might be able to ask them for a EPP. Extended Payment Plan and pay the advance off in 3 pay periods. I think that I will go that route instead of stopping payment on the check. Any thoughts....

      Huh? Was your cash advance included in your Bankruptcy? Hopefully, (please tell me you did), include the cash advance place as a creditor? If you did, they are toast... discharged... over... done!

      If you included them, give them a copy of your Discharge Order and Injunction. They cannot touch your money if they were discharged. If they do attempt to or actually take your money from your bank, send them a letter demanding it back in 5 days. If they don't give it back in 5 days, file a Show Cause motion with the Court to force them too, and to get them spanked as well.

      Oh, and Congratulations on your discharge.

          Did the bk court order you to repay this cash advance because you took it out too close to filing?

            The BK Court Judge told me this debt couldn't be discharged. Because I took a cash advance out while filing yeah yeah I know big screw up on my part. But I had to make ends meet.

              You did what you had to do to survive so no judging here, I was just wondering if that is what happened. Not that I have any experience in this but I am surprised that the bk court didn't tell you how to pay it back. I just noticed you had a reaffirmation hearing, was that for the undischargable debt? Was there an advaserial (I know) hearing? And you did this pro se? Great job!

                    Well I live in the State of Florida, according to the state laws for cash advances. They can not take any legal action, so I am assuming that is why the judge didn't order me to pay it back. I would like to pay it back in installments. But I just might ending up doing a stop payment on the check????????? Don't know if it is in my best interest. But they can't take legal action from what I understand in this state. All the can do is send it to a collection agency. The advance company can do a pursue a civil case against me if the advance is more the $500.00

                      Ahh, that explains why it is non-dischargeable. It was "post-pettiton".
