    Question for 341 Meeting

    My lawyer says this is the question.
    have you made payments over $600 in the past 90 days?.
    But on the web, I found questions like this.
    Have you made any large payments, over $600, to anyone in the past year?
    or
    Did you pay your family or any family member in the past year over $600?.

    Did someone face this at 341?. If yes then was it 90 days or 1 year?.

    The "official" question is... Have you made any large payments, over $600, to anyone in the past year?

    The reason the question is open ended, is so that the Trustee can then narrow it down if you answer it positively.

    Example:
    Tee: Have you made any large payments, over $600, to anyone in the past year?
    You: Yes
    Tee: To whom did you make the payment? Family? Friend? Creditor?
    You: To my Mom
    Tee: Were you paying her back for a previous loan?
    You: Yes
    Tee: Did you pay anyone else?
    You: No.

    In that circumstance, the Trustee finds out exactly what he wants by narrowing and focusing the question. It could have gone this way...

    Tee: Have you made any large payments, over $600, to anyone in the past year?
    You: Yes
    Tee: To whom did you make the payment? Family? Friend? Creditor?
    You: To Bank of America VISA
    Tee: When did you make that payment?
    You: About 30 days ago
    Tee: How much was it for
    You: About $1,200
    Tee: Why did you make that payment?
    You: Because they demanded that I do or they'd sue me.
    Tee: Did you pay anyone else?
    You: No.

    See the difference? The first question is open, so that the Trustee can gauge where to go with the "followup" question.
