    Forgot to exempt my tax refund for 2009

    Im n CA. Is it possiblet to amend my schedules before my 341 hearing takes place on 11/12 or should I leave it alone?

    If I can amend my schedules, will it delay my hearing?

    Yes you can amend before the 341. No it will not change or delay the hearing/creditors meeting. It is best to amend before the 341 anyway....make all of your corrections now.

      my husband and I usually get 10000 back, is that the amount i list on schedule b and c as exempt?

        list on both schedules.. I just put "expected" or anticpated tax return. Obviously you haven't file yet and can't know for certain the amount..

        When you ammend your petition, remember that most districts also require you to re-do your summary and statistical summaries.

            on one of the last pages, there is a section 21. called "other contingent but unliquidated claims of every nature, including tax returns"

            That's where i put mine, and i made a note that i was exempting $3,000 - but it could be a different amount. It's just an estimate.

            But if you usually get a lot back- go with a higher amount.

                oh i forgot, how do i write the specific law for the exemtption on schedule c? and do i mark 11 u.s.c. 522(b)(3)? pr 522(b)(2)?

                So as long as I file the amendment before my 341, will I be ok? or will this delay everything?

                  Before the 341 is best, and print out a hard copy to bring to the meeting.

                    You need to use the appropriate California Statute that allows this. You either used System 1 or System 2 and you need to look that up.

                    You should file this before your 341 Meeting.
