    Where's My Discharge????

    We filed Chp 7 (in Ohio) Oct 12, had our 341 end of November.....Pacer has always been very up to date with our info....our Objection to Discharge was due Jan 30, and so far there is NO change to ANY of our info on Pacer.......I'm getting nervous now, when up to now everything has been smooth. Somone please reassure me, or give me some idea of what is going on?

    I'd call the trustee and ask them about it.

      I'm in the exact same boat. My deadline was also 1/30 and I haven't heard or seen anything new on pacer.
      Under "Flags" in my case summary, it does say "DischDue".
      I'm under the impression that if there was a problem we would have been notified by now

        I just talked to my attorney this morning and he said that my area is just so backed up, that's why I haven't heard anything yet.
        I'm just wondering if this means the US trustee could have objected and it's just not in the system yet.
        Probably just paranoid over nothing

          I would "think" that they would have had to notify your attorney before the objection date, to get an extension if anything was wrong. At least, that's what happened with me. If he didn't say anything about it, you're probably in the clear. So, I believe that it's too late for the trustee to object? Might take awhile to close, but "I think" you should be ok!

            I filed on the last day under the old laws, and the line was wrapped around the corner. The paperwork probably is backed up.

              We filed under the old law and our discharge was due 12/27/05. In January, our pacer acct still said "awaiting 341". I called our lawyer several times until I realized that I must do my own work. I call the bankruptcy clerk at the courthouse and she transfered my to someone with a little more authority. The next woman said "well let me take care of that. There....you are discharged!" three days later, I recieved my discharge paperwork in the mail. Maybe a little call could help you too.

                Yup, I filed at the deadline, too. Had my 341 on 11/23. At that time, my district was hearing about 400 cases per day, every day, for a month before and after this date. I looked at the schedule today, and they're hearing about 20 cases total. So, I'm sure there is a LOT of catching up for them to do!!

                  Just check with the clerk of courts, they will update the info for you at your request....... BE PATIENT.....

                    Same with me, jan 30, and no discharge yet. Don't call your trustee, he has nothing to do with it at this point. Call your case manager at the courthouse. You can probably get the number from the website of the courthouse where you filed.

                        I checked with both my attorney and the court clerk.
                        Both said the delay is due to the back up

                          Checked PACER today......as of the 12th it says "Awaiting Closing"

                          guess that means I'm discharged???

                          sent the trustee our tax papers....we're due to get a $3500 refund....don't expect we'll get to keep any of it
