    Discharged but still getting DMV renewel notice

    Hi guys,

    I have a quick question, I know one of you will have the correct answer

    I was discharged last year and decided to get a new vehicle and "turn in" the vehicle that was dicharged (and not reaffirmed) a few months ago before the tags were due. Anyway, today I get a notice that I am "delinquent" on my tags plus ALL THE LATE PENALTIES!!!....
    Any advice? I looked on the DMV site, but I could only find what to do if I *sold* the vehicle.

    sorry liz to hear about those problems with the DMV....my only suggestion for you, would unfortunately be, to go in a DMV office with a copy of the new sales receipt showing the trade in of the vehicle that was listed and not reaffirmed, i would also bring in a copy of the petition indicating that it was not reaffirmed at the time of the bk.

    it sounds like it would even confused the simplest of the bureaucracy no less a DMV.

      Thanks Toobe43...I was trying to prevent going to the DMV because of all the cut backs and lack of staff (at least here in California), the LINE is AROUND THE BLOCK! I made up my own form with all the car info on it and had the manager at the dealership sign and date it, so that should work I also will take recent info I received from then lender telling me the car had been auctioned off.

        good luck with it...i hear on the cut staff....out here i keep trying to go for my regular drivers lic....i only have a temp, but it's good until 2018...LOL...but every time i go to the DMV to get it made permanent ...half the USA is there and they brought their moms....the lines are out the door!!

        it's a terrible thing...but i think it may be the ONLY way to do it unless you can make a contact and email them of fax them the docs???

            Unfortunately you have to get this taken care of. A friend of mine had that happen, where the dealer did not transfer the title, the car was in an accident and he went through h*** to prove it was no longrer his car. The dealer should have made sure the title was transferred, but as long as you have something to show that, you should get it taken care of.

              another reason to get it transferred out of your name is here in Kalifornia they will take any tax refund to cover the costs if it is not taken care of. years ago i sold a vehicle and the person never transferred the title and i kept getting notices thinking "who cares, i no longer own it". this is AFTER i had mailed in the form to the DMV stating that it was sold along with the persons name and address. so, the final notice i received stated they would garnish any tax refund to cover the licensing fees and that of course got my attention. i got it cleared up, like that day.

                Are you guys saying that I can sell this car that I still owe $11,000 on, even though I didn't reaffirm and won't be making any more payments? Even with the lienholder on the title?
                Filed August 20 341 on September 23 Report of No Distribution - September 24 Case Discharged and Closed on November 23!!!

                  NO!!! after you do not affirm you will either surrender the car....or they will come and get it!

                  really the best way to deal with, if you have no intention of reaffirming is surrendering it and have all the docs signed sealed and in your little hands!!!

                      yeap!!! and just be careful that you're NOT 1000 miles from home and have to walk!!

                      we surrendered the car within our OWN time frame....actually, we were never even late on the payment, but knew after the job loss there was no way we could do it. so we called make arrangements and made it easy as pie...pecan.

                        I saw this form, so should I just put the "lender" as the buyer??

                        Thanks again for all the replies, I didn't realize I had to do anything once I turned over the car and got a signature It's been like over 3 months!
