    UST Statement - Motion to Dismiss is Not Appropriate

    I converted my 13 to a 7 back in July. Had my 341 meeting and everything was fine. Then I got the abuse letter from the US Trustee. They said I had to much income to do a chapter 7. My attorney said to wait and see what they do next. Today is the 29th day and the posted this on Pacer..

    I'm not sure how to look at what was files but I take it that they are moving on and no longer have an interest in me????

      That's the best news I've had all year. October 22nd is the last day for anyone to object and them I'm home free!

        BK2man congrats, I'm jealous. I am now 35 days past the presumption of abuse letter and still not a word for the US trustee. Just my report of no distribution from the panel trustee and sleepless nights.
        Filed 7 - 7/8/10, 341 - 8/17/10 - Continued, Presumption of Abuse Filed - 8/27/10
        Report of No Distribution 9/27/10. Discharged 2/7/11 Closed 02/25/1

          Yep, that's what you want to see! Congrats!
          Ch 13 filed 06/22/09. Dismissed,thankfully, 03/31/10. Ch 7 filed 06/28/10. 341 07/29/10. UST POA 08/06/10. UST mot to dismiss hearing extended to Dec...Feb...March...May...Aug. UST withdrawal of dismissal filed 05/31! DISCHARGED 07/12/2011!

              great news...and YES that means.... in the majority of cases, the bankruptcy trustee will not object to a dismissal. ...
