    Ch.7 and Foreclosure.......

    Ok so we filed Bky and were discharged in Jan 30 10. Now today we get a letter from the mortgage company about Judgement of Foreclosure and Sale. It states that we may have to pay for the auction?? What do people have to pay when they File Ch.7? Taxes? Lawyer fees for the bank? Or do we not have to worry???!?!?!

    They are giving you a ration. You did not reaffirm I assume. You listed intent on walking away. They are scamming you. It will not work. You are free of that debt. 'Hub

        As long as you didn't affirm, you can't be held personally liable for any deficiency created in the foreclosure process.

          we are all assuming you didn't reaffirm...you know what they say about assuming....jrmaso...you didn't reaffirm did you??? are you still living in the house...or did you surrender it???

          if you didn't reaffirm and or you surrendered...you are fine and although they may attempt to bill you in a deficiency state.

            No We moved out and left it before discharge even. We did not reaffirm It was so upside down there was no point it was a townhome with 250k mort. now it appraises at like 120k....
