Will trustee take our tax return??

Our case was discharged on Jan 26. NO assets.

Our lawyer sent us a letter that he, the lawyer,

was closing our file. But we have to send our tax return to the trustee. Our income is $69.000. Family of four. What are the chances the trustee will take our refund, itvwill be about $900. Thanks.

you are leaving out something here...you're case may have been "discharged" but apparently, not "closed". you're atty does not close you're file the court does when all the obligations have been met. it sounds like you were a chapter 7 and would be closed when the trustee rec'd the money from your return.

most likely it will be closed once you turn over your tax refund, really it's worth the $900 to get it done and over.

Understand Our case isnt closed by the courts. But our lawyer is closing our file at his office. So i guess we will just wait and see it the trusree will take our refund after he gets our return. Hope not, could really use it for our car fund.

Usually you will be told at your 341 whether the trustee wants your tax refund or not.

We filled the last day of 2007, and our 341 was Feb. 7, 2008. The lady in line ahead of us was told not to cash her Stimulus Check (Pres. G. W. Bush had issued Stimulus checks early in 2008) without consulting with the trustee first.
