    Moved NY to FL

    We moved to Fl, I bought a house in my name soley, but my wife had to sign the deed, she is not on the loan at all.

    She wants to file in Fl she owns a home solely in NY which is in foreclosure and two older cars worth about $5,000 each.

    That house is under water and far from foreclosing.

    But several other creditors are getting annoying.

    Am I correct that she can file in Fl but use the NY exemptions?

    Any other input in this scenario?

    If you've lived in FL. for less than 2 years then, she'll use NY exemptions.

      So in NY there is a choice NY State or Federal, so that's great.

        we moved from new jersey to florida. we waited out the 2 years to get the wildcard exemption which fflorida offered us since we were not claiming a home but surrendering it.

        it's residency that will make the difference on how you can file. at this point if you live in florida it would be either NY or federal as stated above. if you were in florida for the past 2 years or have been able to establish residency in florida it would be florida, only. if she has been able to establish the house in florida as her main residence that you can file in florida. we also had other property in another state as well as in nj when we filed.
