    Chapter 7 for adult child living at home

    My son is 29 and makes too little money to move out plus we don't mind him being there.
    He passes the means test for either 7 or 13. My question is is he allowed the same deductions from income as if he were out on his own? If use what UST says based on one exemption for himself on taxes I think he should be. Tia!

    He would use the local and federal standards on the means test, but his Schedule J must reflect his actual expenses. If they are too low, the U.S. Trustee could object to a Chap 7 discharge based on totality of circumstances. He should consult with an attorney (or 2 or 3) to find out if that will be an issue.
