    341 tomorrow, nervous

    Hello, well our 341 is tomorrow morning. I'm a bit nervous. My lawyer says our case is pretty much open and shut.

    My biggest thing is our home. Our home is the only thing I can give my kids right now. We are going to reaffirm our mortage. The last mortage payment I made, they wouldent accept my payment at the branch, I had to mail it to the processing center. I'd love to hear from someone that has reaffirmed their home. I'm unclear on the process. I know i have to bring my recorded mortage, deed, property tax statements and mortgaget statements tomorrow to the 341. I've never been late or missed any mortgage payments and we only have about 10K in equity in the house.

    Any reassurance is appricated.

    Don't sweat the 341. 95% go very smoothly and you'll be done in 10 minutes.

    Be sure to bring your proof of identity with picture and proof of your social security number with you to the meeting plus anything else your lawyer or trustee told you to bring. And get there with plenty of time to park and find where the meeting is!

    We're Ch 13 and chose not to reaffirm our mortgage or our home equity loan. We're paying both monthly outside our plan, so hopefully someone else here with more experience with mortgage reaffirmations in Ch 7 will chime in with advice or insights.

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

        Many reaffirms are done at the 341 meeting if the creditor knows that's what you want to do..... this may be the case for you. IF NOT , be sure that the reaffirm is signed, sealed, delivered BEFORE you are discharged.

            Hoping your meeting went well!!!

            I had my 341 meeting this morning and was very nervous. I could not stand it. I now know that I was worried for nothing. It went GREAT!!! I was very pleased with everything including my lawyer.

            I am Very Happy with the way things turned out for me!

              Question about 341

              What kind of questions did the trustee ask? Did they ask for any documents. My 341 is 9/1 and I am so nervous.

                  There were some questions that everyone was getting asked:

                  - If you filed a 2005 income tax? If you received a refund you were asked what you spent the money on and if you can supply reciepts for your purchace(s)?

                  - If you have filed an income tax for the last 4 years?

                  The rest for the most part were just a few more questions specificly related to each individual cases and then that was it. There were probably 12 people ahead of me and all of their's went fast and only one couple had their's pushed back due to lack of information regarding an extention of a 2005 tax filing.

                  (edited) just wanted to add that other than the couple with the tax extention issue above, no one was asked for any documents.
