Is my mother's state Teacher's Retirement exempt from collections, lawsuit, etc.

My mother is 85 and collects her retirement from Ohio State Teacher's Retirement. Would this be exempt from garnishment etc. It will take all her income to stay in the facility. I know SS is exempt, but she does not draw any SS, only her teacher's retirement. She is worried about what will happen if she doesn't pay

Also, she has received calls from a couple of debt collectors, who have my phone number. They go to voicemail, and they identify the name of their company and state they are debt collectors in their msg. I thought they weren't supposed to give that information. They have no idea who will hear the messages. Is this a change to previous rules?

    Thanks!

If it is an ERISA qualified plan, it is exempt in most circumstances. http://www.nolo.com/legal-encycloped...tors-ohio.html http://www.legalconsumer.com/bankrup...itationID=1455

If debt collectors are calling your mother at a number she gave them as her phone number (or maybe even if they have reason to believe it is her phone number), they are required to identify themselves when making collection calls. But, if they are calling you as relative to try to find her, then they aren't supposed to reveal information about the debt.
