My sole support, income, is child support and alimony - what confuses me is why would I want bankruptcy court overseeing all my finances for one judgement? I know I must be missing something here. Child Support and Alimony is exempt in NJ. BTW I've seen FOUR attorneys - they've all told me that alimony (and some told me Child Support) was NOT exempt - all wanted me to file for bankruptcy even after I asked them about payment plans - couldn't have anything to do with collecting more fees???? One attorney told me not to let the police into my house if thet requested to do so as they would be taking an inventory of my assets - there isn't much here!

Your attorney is right. Never let anyone into your house without a valid search warrant issued by a judge. They don't usually do that for a civil matter.

Personally speaking, I NEVER answer the door to anyone I don't know and like. I look through the peep hole of my door, and if I don't know who they are, they can knock on my door and ring my door bell all they want, but I will never answer that door. And they would be breaking and entering if they tried to enter otherwise, which is against the law. And they know this, so they don't do that.

In Arizona, it is well known that the sheriff / police "have no right on entry" into a person's home for a civil matter.

I don't make anything easy for debt collectors. And as a consequence, I have never paid even one red penny of any judgment against me so far. And I never will.
        The world's simplest C & D Letter:
"I demand that you cease and desist from any communication with me."
Notice that I never actually mention or acknowledge the debt in my letter.

Have you tried working out a payment plan? If they already know that your sole income is exempt and they can't get at it, they may be more flexible with you. (But then again they may be stupid). That may be a way to satisfy the judgement and avoid BK altogether. Knowing they can't execute the judgement I'd keep trying to get a payment plan with them worked out. Essentially you'd be doing the same thing as a 13 but without filing.

The judge ordered the levied funds be returned to me - any idea how long that will take?
