I just checked our credit reports and it shows that Fashion Bug charged off our account and filed suit, all for $512.00 . Under the info it shows no docket number and plaintiff is also blank. I guess I should be expecting to be served anyday or do they mail you something saying they are going to file suit against you? I'm not too worried as our chapter 13 will be filed within the next 10 days but if I'm gonna be served I sure don't want it to happen at work (high school!). I guess I just want to know if this is the real thing, they are actually filing a lawsuit or when they charge off an account does this automatically show up? Thanks in advance.

Note that late payments or chargeoffs that occur prior to your filing date will not be removed when you file Chapter 13 because they occurred prior to your filing date. You could be served by anything from Certified Mail to a server at your door (home or work) depending on requirements for service. When and if you do receive the paperwork, just turn it over to the attorney handling your Chapter 13. Since you are filing, it is no big deal._________________________________________

LOL my wife has a Fashion Bug card with a $4400 credit limit!! She's had it since 1987 and it doesn't have a balance. I called and told them we were filing 13 and they said that she is such a good account holder, they will keep the account open..LOLFiled: October 1, 2007 341: December 10, 2007

It all depends on what finance/bank outfit is associated with Fashion Bug. What a customer service rep tells you over the phone compared to what the credit department of the financial institution decides to do if they see BK when they pull credit reports periodically are two different things. Keep your fingers crossed that it will still survive your Plan. I would suggest she charge a small amount ($10-$20)on there now and then and pay the bill in full immediately upon receipt if the card remains open. Well I found it odd too. I wondered if when it showed "charged off" if it automatically showed suit/judgement info on the credit report. It makes me wonder because when I checked my husbands today, Discover Card shows charged off and the same little box says a suit or judgement was added. I'll have to look into this a bit more. Thanks for the info.
